Excerpt from Cases Decided in the Supreme Court of the Cape of Good Hope: During the Year 1869, With Table of Cases and Alphabetical Index Porter (with him Buchanan), for appellant, relied on sec tion 10 of the Land Beacons Amendment Act, 3, 1860, which provides that so often as it shall be found upon any resurvey or other prbce'eding connected with any disputed boundary, that other farms besides those originally engaged in the dispute are really involved in or affected by it, then the owners of every farm involved in or affected by the dis pute shall as well as the farms originally engaged, be deemed to be, for the purpose of the 5oth and 70th sections of Act No. 10, 1859, parties to the inquiry, seas to be liable, at the discretion of the commissioners, to pay, or contribute towards paying, the costs in the said sections mentioned, in such shares and preportions as the commissioners in the said sections mentioned shall, under the circumstances, consider just and shall adjudge. The Legislature had thus imposed upon the commissioners the power of determining what additional farms were involved in or affected by the dispute which had originally arisen between gilvie and Buckley3.
