Ainsi, lorsque celui qui �tait d�biteur envers un cr�an cier d�j� nanti d'un gage a contract� une seconde dette devenue exigible avant que la premi�re f�t acquitt�e, le gage est pr�sum� de plein droit affect� � la s�ret� des deux cr�an ces. Il serait naturel et conforme � l'�quit� de voir une con vention tacite de gage dans la r�tention appartenant � celui qui, comme mandataire, d�positaire, ou � tout autre titre, aurait re�u des objets qui lui auraient occasionn� des d�pen ses ou donn� droit de demander un salaire pour ses soins. C'est encore par une convention tacite de nantissement que les effets d�commerce, entr�s dans les comptes courants dont nous avons parl� n� 476, r�pondent � celui qui les a recas des r�sultats de ce compte; que l'accepteur dune let tre de change, par les raisons d�velopp�es n� 379, n'est pas oblig� de se dessaisir de ce qu'il doit au tireur; que celui qui, soit a titre de d�positaire, entrepositaire ou autre analogue, soit a titre de mandataire simple facteur ou pr�pos� g�rant d'affaires, commissionnaire, agent de change, a recu des valeurs de la personne pour qui il agissait, ou au nom de cette personne, a droit de retenir tout ce qu'il a re�u jusqu'� ce qu'il ait �t� rempli int�gralement de ses avances et salai res, s'il y a lieu.
