Sind die alten Vorschriften des Shermanacts geeignet den Wettbewerb in New Economy M???rkten zu sch???tzen bzw. sind sie ???berhaupt anwendbar? Agiert Microsoft in einem solchen Markt und wie ist dieser zu charakterisieren? Welche konkreten ???konomischen Auswirkungen haben die Strategien der Kopplungsgesch???fte (engl.: Tie-in-Sales) und der exklusiven Vertr???ge im Microsoft Fall? Wirken Microsofts Strategien zum Schutz seines Betriebssystemmonopol nur wettbewerbssch???dlich bezogen auf den zweiten Protagonisten in diesem Kartellrechtsprozess, oder auch gesamtwirtschaftlich wohlfahrtsmindernd? In dieser Arbeit wird versucht durch Fokussierung auf Tying und exklusive Vertr???ge der Beantwortung dieser Fragen ein wenig n???her zu kommen und die verschiedenen Standpunkte einander gegen???ber zu stellen. Dazu wird im ersten Teil das Unternehmen Microsoft, der Markt auf dem es agiert und die im Prozess betroffenen Produkte kurz dargestellt. Im zweiten Teil folgen die kartellrechtlichen Grundlagen und eine kurze Beschreibung des Prozessablaufes. Im 3. und 4. Teil werden dann die Details von exklusiven Vertr???gen und Tying untersucht. Darauf folgt im 5. Teil eine Wohlfahrtsbetrachtung, welche die Grundlage f???r die in der Schlussbetrachtung getroffenen Aussagen darstellt.
