Um diesen Missbrauch einzuschr???nken, wurde 2008 ein Code of Conduct von der European Defence Agency erstellt, den die Mitgliedstaaten auf freiwilliger Basis h???tten einhalten sollen. Das Vorhaben scheiterte jedoch wegen der rechtlichen Unverbindlichkeit des Code. Am 13.07.2009 wurde schlie???lich vom Europ???ischen Parlament und dem Rat die Richtlinie 2009/81/EG erlassen, mit der die EU einheitliche, transparente und wettbewerbsorientierte Regeln f???r die Auftragsvergabe im R???stungssektor einf???hrt. Hervorzuheben ist dabei der Zwang zur ???ffentlichen Ausschreibung oberhalb der Schwellenwerte sowie die Einf???hrung von Rechtsmitteln in Bezug auf Vergabeentscheidungen Diese Arbeit soll die Entstehungsgeschichte und die dahinter stehenden ???berlegungen der Vergaberichtlinie betrachten und dabei herausarbeiten, inwieweit es ihr gelungen ist, auf innergemeinschaftliche Kompensationsgesch???fte nachhaltig Einfluss zu nehmen.
