Drawing on the debate in the USA and in a dialog with the views taken by other disciplines such as literary studies, political philosophy and Jewish studies, this volume undertakes to explore the conditions and perspectives of a dialog between the legal cultures. German description: Die judische Rechtstradition ist in der deutschen Jurisprudenz bislang kaum ein Forschungsthema. Dabei bildet diese Tradition ein faszinierendes Untersuchungsfeld nicht allein fur den Rechtsvergleich, sondern auch und gerade fur eine moderne, an Prozessen der Pluralisierung und Transnationalisierung des Rechts interessierte Rechtstheorie. Die judische Rechtstradition besitzt kein institutionelles Fundament im Sinne eines eigenen, dem des modernen Staats vergleichbaren Justizapparats, sondern ist um einen Text und dessen immer neue, vielfaltige Auslegung zentriert. Damit zeigt sie sich als Alternative zum klassisch-nationalstaatlich gepragten Rechtsmodell.
