Noch in diesen Jahren hatte Wilh. Kalb in seiner Inauguraldissertation ???ber das Juristenlatein (jetzt in zweiter, vermehrter Auflage N???rn berg 1888) dringend n???thig, die Unterschiede der alteren Curietspmche von dem Juristenlatein aufzudecken. Man ver gesse doch nicht, dass zwischen Cicero und Ulpian sowohl die ganze silberne Latinit???t in der Mitte liegt, welche die Tonart der altrepublikanischon Prosa merklich umstimmt, als auch die noch st???rkere Wandlung, der sich die Sprache bei Fronto und den Afrikanern (apuleius, Tertullian) unterzieht, so dass die nicht in Italien geborenen und nicht in dem Studium klassischer lateinischer Litteratur aufgewachsenen Juristen den Einfl???ssen des damaligen Tages und Modegeschmackes ans gesetzt sind, w???hrend Gaius allerdings, wie er der ???ltere ist, so auch ein reineres Latein schreibt. Es ist daher nicht ge stattet, die Worthedentungen, welche nach den Lexicis f???r die Klassizit???t erwiesen, die Konstruktionen, welche nach der Schulgrammatik f???r dieselbe bezeugt sind, unbesehen auf das Juristenlatein zu ???bertragen.
