He refers to the Workmen's Compensation Acts as an analogy But the analogy to Workmen's Compensation Acts only emphasizes the new inequality produced by the National Labor Relations Act, as interpreted and applied: Those acts confer benefits on employees without reference to whether the employees are or are not members of labor organizations. The National Labor Relations Act, in actual Operation, recognizes rights and creates remedies for employees based upon their desire to join labor organizations and deal with the employer through a new entity - the labor organization. The question therefore is not whether the Act is unequal as between employers and employees, regarding each as an individual or legal entity. The question is whether the Act, as applied, is unequal as between the employer and the labor organization. We submit that it is patently unequal in this respect, as applied. It is true that the Act itself confers no benefits or privileges on labor organiza tions as such, but the tendency of Board decisions is clearly in that direction.
