In der pr???genden Phase des Rechtspositivismus geraten die wichtigen politischen und sozialen Kontexte der Verfassung in Vergessenheit, um im Vorfeld der Weimarer Reichsverfassung wieder aufgegriffen zu werden. Damit ist das Feld zwischen einem rein rechtlichen und einem umfassenderen politischen Konstitutionalismus in Deutschland im 19. Jahrhundert abgesteckt.
