Excerpt from The Theory of the Law of Evidence as Established in the United States, and of the Conduct of the Examination of Witnesses I have, for several reasons, confined my citations of authorities almost entirely to text-books. In the first place, this book is designed to be a statement of established rules and not a collection of decisions, and general rules are usually more accurately stated in the text-books than in the decisions of reported cases.
