Complaints of his conduct at Stratford had been lodged with the court. He was summoned to appear before that body, whose deliverance, after examination, ran: "That the acts of Davenport do, and have a natural tendency to, disturb and destroy the peace and order of this government. Yet it further appears to this Assembly that the said Davenport is under the influence of enthusiastical impressions and impulses, and thereby disturbed in the rational faculty of his mind, and therefore to be pitied and compassionated, and not to be treated as he otherwise might be." With this opinion, the assembly ordered his transportation to his home at Southold.1 1 Records, VIII, 440. Ibid., VIII, 454. Ibid., VIII, 570. Another subject of legislative censure was Benjamin Pumroy. He was first summoned before the court with James Davenport, but was discharged. Afterward he was again summoned on a bill of information charging him with preaching that " the late law concerning ecclesiastical affairs was a foundation to encourage persecution... was made without reason and contrary to the word of God... that great men had fallen in and joyned with those who are on the devil's side and enemies of the kingdom of Christ.... There is no colony so privileged as Connecticut was, and now there is no colony so bad for persecuting laws." Pumroy was arraigned before the court, found guilty, and fined, 50, with costs at 32 10....
