The act Of 1705, however, which is the earliest legislative provision now in force on the subject Of attachments, made no dis tinction between the two kinds, - foreign and domestic. That distinction, which now separates the two modes of' proceeding, was not marked out by the legislature, until the passing of the act of 1723.
