R, 10. (503.) Does an imminent and immediate danger of capture, &c., constitute such a case of "necessity," as will justify the master in unlading without authority as aforesaid f An imminent and immediate danger of capture, &c., constitutes such a case; but not if the danger be remote, or not instant and pressing. The danger must act directly on the goods or vessel, and the circumstances must be such as render an immediate unlading indispensable to the safety of the goods, and not merely such as render it hazardous or impracticable to carry the goods to their port of destination. United States v. Hay ward, 2 Gallison's Rep., 486. (504.) To set up the defence that goods were unladen by unavoidable accident, &c., must not proof thereof be made before the Collector f No person can be permitted to set up the defence that the goods were unladen by unavoidable accident, necessity or distress unless he has made the requisite proof thereof before the Collector; or has been prevented by inevitable accident, &c., from furnishing such proofs.
