The Old-English law, never formally abolished, but merely modified under the circumstances of foreign rule, often disguised under a show of foreign names and foreign laws, still lived on, ready at any moment to show itself again in some new shape, and to turn the very evils and wrongs of the foreign rule to its own behoof. The centralized despotism of the Norman Kings failed to root out the ancient popular jurisprudence of England. For a while despotism made use of freedom as its instrument. As it was, the intrusion of the King's judges into the popular courts really preserved the popular element, by causing it to take a new form, one better suited than the ancient one for the needs of later times. So it is in all things; we have advanced by going back, but it was the momentary check of the foreign rule which has enabled us to.go back. Step by step we have thrown off the yoke; but we have been able to throw off the yoke only because the yoke was there to be thrown off. And it is the process of throwing off a yoke which ever makes freedom surest. Had there never been a time of foreign tyranny, our liberties might have crumbled away without our knowing it. It was the foreign tyranny which...
