Likewise, Textor has not altogether avoided the mistake of mixing up law and morality, a mistake due to his assuming the immediate existence of a Law of Nature - which must not be confounded with the argument based on the nature of the thing, an argument which considers certain definite relations as of an undoubtedly positive character it is this mixing up of law and morality that accounts for his drawing a juridical distinction between bellum justum and helium injustum.
