The Time to which they muft refer therefore, is, that, when a formal Application was made to them, under the Provifions of the Act, which was in May, and was the only Time when Thompfon interfered in thefe Tranfactions., Now, with regard to the Tranfaction itfelf, fuch are the Fads; and the only Ground on which I put the Point, is this; was there not under all thefe Circumftances, fair Reafon to fuppofe, that Sir Walter Stirling at the Time when he held the Converfation on the a/th with Mr. Polhill, had a right to fuppofe that the Property was his by the Agreement of Martin. 2 I Will I will make no Comment upon the Non-production of Martin by my learned Friend at firft, although Mr.Pclhill had ftated in his Evidence, that all the Parties would be produced to fpeak for themfclves. I will make no Comment upon the Oblervation made and the Evidence given, to fhew that the Man was out of his Senfes. He has been before the Committee, and appears as much in Poflcffion of his Faculties as any Man of his Age can well be expected to be. KVhereEvidence is not called that might be produced, ir always affords a ftrong Prefumption that it can difclofe forne Facts important to the other Side, if the Clue can be difcovered which may lead us to find them. This Clue, if there was one, has not been found by us; and Candour compels me to admit, that no material Difclofure has been made by this Man, cither on one Side or the other. I mall therefore difmifs his Evidence, with this Remark, that it neither makes the Evidence given by Round nor by Arkinfta!!, but tliatthey are uniform and confiftent, and in Corroboration of the Cafe I have made out on the Part of Sir Walter Stirling.
