Auch Deutschland steht vor der Frage, ob es seine ausgefeilte Grundrechtssystematik dieser Entwicklung preisgeben will. Gabriele Buchholtz hat sich diesem Problem im Hinblick auf das "Politikum" Streik gewidmet. Welche Konsequenzen sich insoweit aus dem "europaischen Grundrechtsgefuge", vor allem aus Art. 6 Nr. 4 ESC und dessen Anwendung durch den EGMR und den EuGH ergeben, ist weitgehend unklar.
