Initiated by the draft of a so-called adhesion procedure, questions of the allocation of jurisdiction arise, which can be considered and answered both in terms of legal policy and legal doctrine. The focus here is also on the question of the extent to which Art. 34 sentence 3 of the Basic Law (Grundgesetz) precludes a reconsideration of the division of jurisdiction. German description: Der Autor hinterfragt anlasslich des Entwurfs eines sog. Adhasionsverfahrens die Rechtswegzustandigkeit besonders im Staatshaftungsrecht. Er zeigt auf, dass die derzeitige Konzeption nicht in der Lage ist, im Einzelfall naheliegende Sachzusammenhange zu berucksichtigen und stellt sodann dar, dass verfassungsrechtlich wenig gegen eine flexiblere Handhabe der Rechtswegzustandigkeit einzuwenden ist. Im Staatshaftungsrecht wird das strikte Entweder-Oder der Zustandigkeiten dem Sachzusammenhang zur Fachgerichtsbarkeit haufig nicht gerecht und verspricht das punktuelle Nebeneinander von Gerichtsbarkeiten eine Verbesserung des Rechtsschutzes. Art. 34 Satz 3 GG wird hierbei einer Untersuchung unterzogen, die im Ergebnis zu einer zeitgemassen und weniger starren Einordnung in das Rechtsschutzkonzept des Grundgesetzes fuhrt.
