Search for compliance with the order, and without result, must take place and be sworn to, and also service of notice, of the application (h). Notice of motion should state the ground of the application, e.g., " for your default in obeying the order made herein on the day of "(t); and should ask for costs against the person in contempt (AOService of notice (I) must usually be personal. If difficulty arises in effecting it, and the original order has been personally served, proved of service in the ordinary way upon the party's solicitor, (m), or at his residence (re), or place of business (o), will suffice, on leave first obtained (p). Appearance at the hearing usually waives objection to insufficiency of service (q), but not always (r). Affidavits in support, copies of, must be delivered with the notice, or two clear days before the hearing (s). Personal service of the order disobeyed follows the usual rules as to personal service (t). Objections to the order disobeyed, on proceedings for non-compliance, are out of time, subject to the judge's discretion (a). Issue of attachments.--Only in extreme cases (a;). Purging contempt will not release the party in default from the costs of the motion (y). Non-payment of money into Court.--A husband who has not complied with an order to pay or secure his wife's costs of the hearing, attending for cross-examination (z) as to his means, will escape attachment if he has no means (a).
