Had these barons done homage to the new lord, and received a renewal by letters-patent of their baronies? Had they done homage to the Pope for their fees? No. They were excommunicated by the Pope, the head of the fee; they were a broken baronage, and as such were no barons at all, but yeomen or copyholders only--only copyholders--of King John, the freeholder of the Pope. The barons who assembled at Runnemead were out of the pale of the law. They were outlaws in a state of insurrection against the lord-paramount the Pope, and his freeholder, King John. The Title To Magna Chaeta Is Invalid. Copyholders could not legislate as barons of the realm. Copyholders could not attest legislative enactments with baronial seals. In Ad. 1213 the baronage was broken, and remained so for one hundred and fifty-four years at least; for during those years the rent was paid to the Pope. But we must look a little more closely at this famous or infamous and ignorantly lauded ' Charter, ' and, in detail, expose its worthlessness as a thing of LAW. Matthew of Westminster,1 when writing on King John's surrender of his crown and kingdom to the Pope as a free gift, gives the following as the confirming Charter of surrender: --"Therefore we, holy grace itself inspiring us, in accordance with the excellent counsel of our barons, do offer and freely grant to God, and to his holy apostles Peter and Paul, and to the holy Roman Church our mother, and to our lord the Pope, Innocent III., and his successors, all the...
