The nature of race-based employment discrimination and its proper remedy continue to be a topic of much public debate. Scarce, however, is the kind of dispassionate scholarly treatment that lends a helpful long-range perspective on the matter. Paul Moreno here retraces the legal and political responses to racial bias in America's workplaces. Race-conscious efforts to promote black employment, Moreno shows, arose during the Great Depression and gained increasing momentum until World War II. From 1941 to 1964 improved economic conditions and postwar expansion made the preferential quota schemes of the 1930s seem inappropriate, according to Moreno. However, in the ensuing years, economic changes and a new civil rights agenda fostered the return of many of the racial strategies and arguments of the 1930s. By 1972 the Supreme Court, Congress, and the executive branch had validated the disparate impact theory, thereby establishing proportional representation as the new meaning of fair employment. From Direct Action to Affirmative Action makes clear that the demand for preferential employment practices originated decades before 1964. By casting the development of modern national policy in a broader historical context, it brings depth and nuance to an understanding of this important area of civil rights.
