Die Entwicklung in ???sterreich im 16. und 17. Jahrhundert war der deutschen Entwicklung sehr ???hnlich. Vor allen Dingen in Rechtsfragen, denn das lokale Recht, welches von dem deutschen Recht gepr???gt war, paarte sich mit dem r???mischen Recht und es entwickelten sich lokale Regelsammlungen. Die Monarchin Maria Theresia (1717-1780) war sehr von der in ganz Europa erfolgenden Aufkl???rung gepr???gt und beauftrage 1753 eine Kommission zur Vorbereitung eines ???sterreichischen Zivilgesetzbuches. Im Jahre 1766 wurde der Codex Theresianus vorgestellt, der sich auf das b???rgerliche Recht beschr???nkt und somit die St???nderegelungen nicht beeinflusst. Doch dieser Kodex stie??? auf gro???e Kritik und Ablehnung und deshalb wurde 1790 eine neue Kommission gebildet, die 1796 die erste Fassung des Allgemeinen B???rgerlichen Gesetzbuches vorlegte.
