Ziel dieser Bachelor Thesis ist es, den Aufbau sowie Ziele der EMIR-Verordnung herauszustellen und daraus m???gliche Folgen f???r Banken und Unternehmen abzuleiten. Auf dieser Basis erfolgt eine Bewertung der EMIR, ob ihre Kernziele nach mehr Sicherheit und Transparenz erreicht werden. In Kapitel 2 werden zun???chst Grundlagen des Derivatehandels sowie Gr???nde f???r eine aufsichtsrechtliche Beachtung dargelegt. Der zuvor gr??????tenteils bilateral abgewickelte Derivatehandel erf???hrt nun durch die EMIR-Verordnung eine zuvor nicht vorhandene aufsichtsrechtliche Aufmerksamkeit. Im dritten Kapitel wird der institutionelle Rahmen sowie Entstehungsprozess der EMIR beschrieben.
