Aus der Perspektive des GATT/WTO-Systems stellt sich die Europ???ische Gemeinschaft als eine regionale Pr???ferenzzone nach Art. XXIV des Allgemeinen Abkommens dar. Das Verh???ltnis zwischen Regionalismus und Multilateralismus ist im Verfassungssystem der Welthandelsorganisation aber nach wie vor ungekl???rt. Aus der Perspektive der Europ???ischen Gemeinschaft handelt es sich bei der WTO um eine Freihandelsordnung, die auf eine weitere ???ffnung des Binnenmarktes nach au???en ausgelegt ist. Der Verfassungskompromi???, auf welchem die Europ???ische Gemeinschaft ruht, beinhaltet jedoch zahlreiche protektionistische Elemente im Au???enhandelsbereich. Konflikte auf der V???lkerrechtsebene sind damit geradezu vorprogrammiert (Stichwort Bananenproblematik). Breiter Raum wird der Aufteilung der au???enhandelspolitischen Vertretungsbefugnis zwischen Gemeinschaft und Mitgliedschaften in Gefolge des Gutachtens 1/94 sowie der Frage der unmittelbaren Anwendbarkeit des GATT/WTO-Rechts gewidmet. Dabei wird gepr???ft, inwieweit das WTO-Recht nunmehr eine unmittelbare Anwendung voraussetzt bzw. ob alternative Ans???tze (beispielsweise eine v???lkerrechtskonforme Auslegung) vergleichbare Ergebnisse liefern k???nnen. Besonderes Augenmerk wird dem Reziprozit???tsprinzip sowie dem Transparenzgrundsatz gewidmet.
