Durch das bewusste Eingehen immer gr??????erer Risiken und deren globalen Streuung haben Banken die Finanzkrise (mit)verursacht und gezeigt, dass sie ihrer origin???ren Aufgabe als Finanzintermedi???r zwischen Kapitalgeber und Kapitalnehmer nicht angemessen gerecht wurden. Mittels derivativer Finanzinstrumente wurde das Ausfallrisiko der in den USA begebenen Immobilienkredite auf der ganzen Welt verteilt und die Stabilit???t des Finanzsystems geriet ins Wanken.2 Um aber die Leistungsf???higkeit von Volkswirtschaften sicherzustellen, bedarf es eines effizienten und stabilen Banken- und Finanzsystems. Die Finanzkrise offenbarte die Instabilit???t des Systems und die damit verbundenen volkswirtschaftlichen Konsequenzen, deren Ausma??? bis heute nicht abschlie???end beziffert werden kann. Uns wurde vor Augen gef???hrt, wie verg???nglich eine vermeintlich gegebene Stabilit???t sein kann und folglich r???ckte der Fokus auf die Sicherung der Funktionst???chtigkeit ebenjenes Systems. Durch eine umfassendere und strengere Regulierung sollen die Gesch???fte und insbesondere der Derivatehandel von Banken nun transparenter und weniger anf???llig f???r Ausf???lle werden. Die Bankenaufsicht in Deutschland wurde bzw. wird hierf???r im zunehmenden Ma???e ausgebaut und stetig durch neue Richtlinien und Verordnungen seitens der Europ???ischen Union erg???nzt. Ziel der Bankenaufsicht ist es, "Mi???st???nden im Kredit- und Finanzdienstleistungswesen entgegenzuwirken, welche die Sicherheit der den Instituten anvertrauten Verm???genswerte gef???hrden, die ordnungsgem??????e Durchf???hrung der Bankgesch???fte oder Finanzdienstlei
