C. 19 Barb. 391; Ayruult v. Pacific Bank, 47 N. Y. 570; Indig v. Brooklyn City Bank, 16 Hun, 200; Beeves v. St. Bank of Ohio, 8 Ohio St. 465. V. Bradslreet v. Ever son, 72 Pa. St. 124; Lewis & Wallace v. Beck & Clark, 10 Ala. 142, and Pollard v. Bowland, 2 Blackford, 22, are sometimes quoted as according with the cases last cited. We think they are distinguished from all the conflicting cases above referred to, by the fact that the parties receiving the paper, being collecting agents only, became bound, either by express or implied contracts, to make the collections themselves.
