Such jurisdictional conflicts have arisen from the overlapping of legal competencies within a multi-level system of peaceful conflict resolution. From the vantage of position law, the author analyses the applicability, dogmatic positioning, scope and consequences of the procedural and functional mechanisms as well as the test-cases for constitutional law and the standing process of judicial review through which ultimately determine the jurisdiction of the Federal Constitutional Court.
