He was not part of the Historical School of Jurisprudence surrounding Hugo and von Savigny, but rather chose to maintain an independent position. He remained distant to their anti-codification view and strict orientation towards ancient Roman law, always keeping in mind the needs of legal practice and the ideas of late secular natural law. Von Savigny rejected Thibaut's politically hopeless call for a German civil law codification and simultaneously introduced the public to the program of the Historical School. Even today, Thibaut is widely recognized only as the 'loser' of this debate. Two hundred years after these events, this volume provides the extensive reappraisal of his personality and works that is demanded. Deren kodifikationsfeindliche Haltung und Ausrichtung auf das antike romische Recht blieben dem auch der juristischen Praxis und dem spaten Vernunftrecht verbundenen Thibaut fremd. Thibauts politisch ohnehin chancenlose Forderung nach einer deutschen Kodifikation des Burgerlichen Rechts wies von Savigny scharf zuruck und nutzte die Gelegenheit, das Programm der Historischen Schule publikumswirksam vorzustellen.
