App. 363, 138 Pac. 57. foreign corporation while within the state upon business of the company is proper.82 A foreign corporation owning property within a state may be served by attaching the property and publishing the summons.8 The service of a writ of garnishment against a foreign corporation is sufficient when made upon its local manager.8 t 3478. Allegations of corporate existence.--Where the defendant in a suit brought by a foreign corporation answers to the merits, he admits the capacity of the plaintiff to sue, and a supplementary answer raising such issue may be stricken out or attacked by demurrer;35 but a denial in the original answer of plaintiff's corporate character compels the plaintiff to prove the same.86 3482. Corporation's liability for torts.--An action will lie against a corporation as well as an individual for malicious prosecution,37 or for fraud,38 or for conspiracy,39 but not for punitive damages for the gross negligence of its servants.40 3485. Allegation of residence.--A corporation has no absolute power to have all actions brought against it tried in the county where its principal place of business is located, 32 Spokane Merchants' Assn. v.
