Ball, 1 Mood. C. C. 330); and, indeed, the 14 & 15 Vict. c. 19, s. 11, which gives any person the right to apprehend persons committing indictable offences in the night applies to persons night poaching, although the night is defined to begin and end at different times in the 9 Geo. 4, c. 69 and 11 & 15 Vict. c. 19 (Reg. v. Sanderson, 1 F. & F. 598, per Willes, J.) Vide the notes, to s. 1, p. 110. The 7 & 8 Vict. c. 29, supra, as to being on public roads by night is not applicable to this offence; but, possibly where the soil of the road belongs to the owner of the adjoining land, any act of the offender showing his purpose to be within this section (9th), would be held to be an entry on the land, as it was held to be under similar circumstances in a case of trespass (Reg. v. Pratt, ante, p. 60, n.).
