But where part of a squadron, detached from the rest, upon a particular service, with orders "not to be out of sight," captures a prize', being out of Jight in consequence of hazy weather or any other accident; this circumstance was held not to defeat the interest of the associated squadron, upon the same principle which would have given it a claim to share, .in case a capture had been made by one of its own strips, which might not have been dispatched under such an order. The Forfigheid, (3 Rob. Adm. Rep. pp. 311. 318). In the case, however, of a prize taken by an hired armed tender, attached to a man of war, it is necessary to prove by written documents, that such tender acted under the orders of such ship of war, in order to entitlethe latter to an interest in the prize, as a joint-capture.
